Consent to the Processing of Personal Data:

I. Consent

By means of this Privacy Policy, the undersigned expressly gives consent for FPMI SERVICES MÉXICO, S.A. DE C.V./FPMI INTERNATIONAL MEXICO, S.A. DE C.V. (Hereinafter referred to as “FPMI MEXICO”) treatment of his or her personal data under the terms and conditions and for the purposes set forth herein.

II. Responsible for the protection of your personal data

III. Purpose and use of your personal data

FPMI MEXICO’s treatment of personal data will be collected for the following purposes:

  • Integrate the work record of each of our employees.
  • To have the information needed to manage the payroll of our employees.
  • Perform all activities related to the promotion and administration of our workforce.
  • Carry out activities related to the fulfillment of its undertaking's objects.
  • Meet with all the requirements by Law; and
  • The performance of each and every one of the operations and conduct of the other acts that FPMI MEXICO can perform under the law and its bylaws.

The treatment of the personal data shall be as necessary, appropriate and/or relevant to the fulfillment of the purposes set out in this Privacy Policy, and for other purposes that are compatible or similar to those set out in this Privacy Policy.

IV. What personal information is collected by FPMI MEXICO and where from?

For the purposes outlined in this Privacy Policy, the personal data collected to be collected may include, among others, the following:

  • Age
  • Sex
  • E-mail address
  • Salary and employee benefits
  • Current job and earlier ones
  • Personal references
  • Job References
  • Federal Tax Register (RFC)
  • Act d Birth
  • Proof of address
  • Official ID
  • Letters of recommendation
  • State and Federal Letters of criminal background
  • Proof of studies
  • Proof of membership or affiliation to the Social Security (IMSS)

The personal information that will be treated by FPMI MEXICO is collected through various means, including the following:

Law abiding, FPMI MEXICO can obtain certain personal information through public sources, such as Internet, by phone, job boards, or any other means of public information. FPMI MEXICO may combine personal information received from a source with information received from other sources.

V. Data transfer

To fulfill the purposes set out in this Privacy Policy as well as with the different purposes which are compatible or alike, FPMI MEXICO will held certain transfers of personal data within and even outside of Mexico to various third parties related to FPMI MEXICO, as are their companies and affiliates holdings.

The responsible to forward the Privacy Policy shall communicate this Privacy Policy and the purposes for which the holder held its treatment, and the third receiver will assume the same obligations that apply to responsible data transferred, so the treatment of data will be subject to this Privacy Policy.

We commit not to transfer your personal information to third parties without your consent, except as otherwise provided in Article 37 of the Federal Law on Protection of Personal Data Held by Private Parties, and to make this transfer in the terms established by such law.

Under the Privacy Policy, the holder of personal data transfer accepts ALL personal data held by FPMI MEXICO in the terms set out in this Privacy Policy.

VI. Exercise of ARCO Rights (access, rectification, cancellation and opposition)

In relation with this Privacy Policy and the treatment of personal data to be given hereunder, the holder of personal data have the following rights: (i) access their personal data and details of their treatment; (ii) to rectify their personal data in case it is inaccurate or incomplete, (iii) to cancel the personal data use if he or she decides that their personal data is not being used for any of the purposes outlined in this Privacy Notice, or they are being used for any other purpose without consent or their purpose of relation has ended with the relationship with FPMI; and (iv) object to the processing thereof for specific purposes.
The exercise of these rights must be made through the submission of the relevant application to the FPMI MEXICO’s Department of Privacy noted in Section II above, by any means provided therein.
The request must contain the following information:

  1. Name, address, e-mail address (or any other means by which notifies the answer to your request), date of birth, and telephone number, including a copy of an official ID.
  2. In case of being a legal representative, attach a copy of the document accrediting him as such.
  3. Clear and accurate description of the personal data on which you are seeking to exercise any of the rights mentioned above.
  4. Any other item or document that facilitates the location of such personal data.
  5. Clear and accurate description of what right do you seek to exercise, on what basis and for what purposes; and
  6. In the case of requests for correction of personal information, you must indicate the changes to be made and provide documentation supporting your request.

The deadlines to meet your request are as follows: The answer will be communicated in a timeframe no later than twenty days from the date of receipt of the request of access, rectification, cancellation or opposition, the determination made to the effect that, it proceeds accordingly, it will take effect within fifteen days of the date on which the answer is submitted.
The periods referred to above may be extended by FPMI MEXICO once for an equal period, provided that this is justified by the circumstances of the case and that the applicant is notified.
FPMI MEXICO may deny the exercise of rights of access, rectification, cancellation or opposition to the processing of personal data, in the following cases:

  1. When the applicant is not the holder of personal data, or that the legal representative is not properly credited for it.
  2. When within our database we have no personal data of the applicant.
  3. When it adversely affects the rights of a third party.
  4. Where there is a legal impediment, or resolution of a competent authority, that restricts access to personal data, or does not allow rectification, cancellation or opposition thereof; and
  5. When the rectification, cancellation or opposition had been previously performed.

The refusal referred to in the preceding paragraph may be partial, in which case FPMI MEXICO will perform the access, rectification, cancellation or opposition to the share that has been required by the owner.
In all previous cases, FPMI MEXICO shall report the reason for its decision and communicate it to the owner or, if it’s the case, to the legal representative, in the terms established for this purpose, through the media specified in the request, accompanied, where appropriate, by the proofs that are pertinent.

VII. Withdrawal of consent to the processing of your data

At all times the owner may choose to limit the use or disclosure of their personal data or revoke their consent to give treatment to them, on the understanding that any processing of personal data will be subject to the consent of the owner, unless otherwise provided by the Law.
To exercise any of these rights, you must submit an application through the FPMI MEXICO’s Department of Privacy, as provided in Section II of this Privacy Policy.
Your application must include the following information:

     
  1. Name, address, email address, date of birth and telephone number, including a copy of an official ID.
  2. In case of being the legal representative, attach a copy of the document accrediting him as such.
  3. Clear and accurate description of the personal data for which it is seeking to stop the use thereof, also indicating if it is either or all of their personal data; and
  4. Any other item or document that facilitates the location of the personal data.

We shall inform you about whether appropriate or not of your request within a maximum of twenty days answering through the media specified in your request.
It is noteworthy that, despite your request, FPMI MEXICO may give treatment to some information as permitted or required by Law.

VIII. Changes to the Privacy Policy

FPMI MEXICO reserves the right to make changes at any time or updates to this Privacy Policy, in attention of new legislations, internal policies or new requirements for the provision or offer of our services or products.
These modifications will be available to the public through the following means: (i) on our website in the Privacy Policy section, (ii) we will deliver them to the last email that we were provided; or (iii) physically through FPMI MEXICO’s Department of Privacy as provided in Section II above, which will be at the discretion of FPMI MEXICO. The changes will take effect immediately upon occurrence of any of the three scenarios set out in this paragraph.

IX. Security and Storage

FPMI MEXICO will do everything in its power to protect the privacy of information and personal data. It may occur that under court orders, or legal regulations, FPMI MEXICO may be forced to disclose information to authorities or third parties; or in cases where third parties were to intercept or access to certain information or data transmissions in which case FPMI MEXICO has no liability for information that is disclosed in these forms. THEREFORE, being aware and accepting the contents of this Privacy Policy and the provisions to which the treatment of my personal data is subject, in this act, I expressly grant my consent for FPMI MÉXICO to treat my personal data under the terms and conditions hereof.
